Terms of service
Last updated: April 21, 2026. Please read these Terms carefully. They govern your access to and use of GetPayment ("GetPayment," "we," "us," or "our") and our websites, applications, and related services (collectively, the "Service").
Agreement to these Terms
By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
If you use the Service on behalf of a company or other legal entity, you represent and warrant that you have authority to bind that entity, and "you" refers to that entity.
Definitions
- Merchant / you: the person or entity using GetPayment to issue invoices and receive payments.
- Payer / customer: your client or end customer who pays an invoice through the payment methods we enable.
- Platform fees: fees assessed by GetPayment on paid invoice amounts (including percentage-based platform fees described on our pricing page), subject to your plan.
- Subscription fees: fees for paid GetPayment subscription plans (e.g., Plus or Pro), billed via our payment processor as disclosed at checkout.
- Payment processor: third parties such as Stripe that vault cards, process charges, facilitate payouts, and operate dispute programs on their networks.
- Settlement currency: the currency in which balances, fees, and withdrawals are calculated and displayed in the Service (for example, U.S. dollars), subject to processor capabilities and your account configuration.
Eligibility & accounts
You must be at least the age of majority in your jurisdiction and able to form a binding contract. You must provide accurate registration information and keep it current.
Account security
You are responsible for safeguarding credentials and for all activity under your account. Notify us promptly at the contact below if you believe your account is compromised. We may require multi-factor authentication or additional verification where we deem appropriate for fraud prevention.
The Service & third-party services
GetPayment provides software to create and manage invoices, hosted payment and checkout experiences, reporting and analytics features as offered in your plan, and tools to request withdrawals or payouts of collected funds, subject to verification and payment-processor rules.
Payment processing, Know Your Customer (KYC) checks, payout timing, reserves, and card network rules are operated by payment processors (for example, Stripe). Your use of those features is subject to their terms, policies, and acceptable use requirements, which may change independently of these Terms.
We may modify, suspend, or discontinue features of the Service with reasonable notice where practicable; we may also change integrations if required by law or by a payment partner.
Not a bank; custodial role of processors
GetPayment provides software and is not a bank, money transmitter, or deposit-taking institution. Customer funds collected on your behalf are settled and safeguarded according to your payment processor's licenses, agreements, and network rules, not as insured bank deposits through GetPayment. You are responsible for reviewing your processor's disclosures on FDIC pass-through insurance, e-money safeguards, or equivalent protections where they apply in your region.
Your content & invoices
You retain ownership of data you submit ("Your Content"). You grant us a worldwide, non-exclusive license to host, copy, process, and display Your Content as reasonably necessary to provide and improve the Service and comply with law.
You represent that your invoices and descriptions are truthful, lawful, and comply with applicable consumer protection, pricing, tax, and export laws. You are solely responsible for goods or services sold to payers, customer support related to those sales, and issuing any legally required receipts or tax documentation.
Fees, taxes & billing
Platform fees
Platform fees apply to paid invoice amounts according to your plan (including free, Plus, or Pro tiers) as described on our Pricing page. Fee percentages, daily volume caps, and feature availability may change with notice as described below.
Subscription fees
Paid plans are billed on the interval you select (for example, monthly or annual) via Stripe Checkout or the billing portal. Subscription fees are charged to the payment method on file until cancelled. Taxes may be added where required.
Taxes
Fees are stated exclusive of applicable taxes unless otherwise indicated. You are responsible for any taxes associated with your use of the Service (excluding taxes on our net income).
Payment processing costs
Card-network fees, interchange, and processor charges may apply to transactions and may be deducted by the payment processor before settlement. Such costs are governed by your processor agreement and network rules.
Chargebacks, reversals & fee recovery
If a payment is charged back, disputed, reversed, returned (for example, ACH return), or otherwise debited after you have received credit in the Service or been paid out, you remain financially responsible for the underlying transaction and for all related costs. You authorize us and our payment partners to debit, set off, withhold from future settlements or balances, invoice you, or use other lawful means to recover any amounts we or processors must return to payers, issuers, or networks, including chargeback fees, dispute fees, representment fees, arbitration or compliance assessments, network fines, and similar charges, whether or not you ultimately win the underlying dispute. Where a dispute is decided in your favor, recovery of some fees may still be subject to network and processor rules and is not guaranteed.
Platform fees assessed by GetPayment on collected invoice amounts are generally earned when payment succeeds; unless we expressly state otherwise in writing, chargebacks and refunds do not automatically entitle you to a refund of platform fees already charged, and we may net such fees against future balances where permitted by law and processor agreements.
Refunds & credits
GetPayment subscription fees
Subscription charges are generally non-refundable except where required by law or where we expressly agree otherwise in writing. If you believe a subscription charge was duplicated or processed in error, contact us promptly with supporting details; we will review good-faith billing disputes on a case-by-case basis.
Downgrades or cancellations take effect according to the settings in your billing portal or account; you remain responsible for fees accrued before the effective cancellation date unless we state otherwise at checkout.
Invoice payments & your customers
Refunds of amounts paid by your customers for your goods or services are between you and your customer, subject to your policies and applicable law. You may issue refunds through the tools your payment processor provides where supported. GetPayment does not guarantee that a refund will reverse or offset platform fees already assessed on the original transaction; processor and network rules apply.
Platform fee adjustments
If a transaction is refunded or reversed in whole or in part, platform fees may be adjusted, forfeited, or clawed back according to processor settlement timing and our internal accounting practices as disclosed in the product or help documentation.
Chargebacks & payment disputes
Card and bank networks allow payers to dispute charges ("chargebacks" or "disputes") with issuing banks. Disputes are governed by network rules (for example, Visa, Mastercard, ACH) and the payment processor's dispute process.
Your responsibilities
- Monitor dispute notifications from your payment processor and respond within published deadlines with accurate evidence (invoices, delivery proof, communications, terms accepted by the payer).
- Maintain fair return, refund, and cancellation policies and make them available to customers as appropriate.
- You acknowledge that lost disputes, penalties, or additional fees charged by processors or networks may apply and may be passed through to you.
Merchant bears dispute-related fees and losses
You, not GetPayment, are solely responsible for the full economic impact of chargebacks, payment disputes, and payment reversals on your business, including without limitation: the disputed transaction amount; fixed and variable chargeback and dispute administration fees charged by the payment processor or network; currency conversion or cross-border fees assessed in connection with a dispute or reversal; representment and appeal costs; arbitration, monitoring, or compliance program fees; fines or liquidated damages imposed by card brands or regulators where passed through by a processor; and any negative balance created when debits exceed available funds. GetPayment does not absorb these costs on your behalf.
We may display dispute summaries in the Service for convenience, but fee schedules, reason codes, and final debits are controlled by processors and networks. Amounts may be collected in a different currency than your settlement currency; in that case, you bear any conversion spread, markup, or bank fees applied by the processor or your financial institution when obligations are satisfied.
Our role
GetPayment facilitates your use of processor tools but does not decide the outcome of card network disputes. We may suspend features, delay payouts, or terminate accounts where we see excessive dispute rates, fraud indicators, or violation of processor or network rules.
Fees, timing & reserves
Chargeback and dispute fees, representment costs, and currency conversion may be assessed per the processor's pricing. Funds may be debited from your balance or future settlements. Timelines for response and final resolution depend on the network and issuer and are outside our control.
Processors may place rolling reserves, collateral holds, or delayed settlement on your account to mitigate dispute and credit risk. Those arrangements are between you and the processor; GetPayment may reflect balances and restrictions in the Service as reported by the processor.
Payouts, withdrawals & currency conversion
Withdrawals of funds available in your GetPayment wallet are routed through your connected payment processor account (for example, Stripe Connect) to your designated bank account or payout method. Payout timing, rails (ACH, wire, local schemes), and eligibility depend on verification status, jurisdiction, processor risk settings, and banking holidays.
Verification & accuracy
You must complete identity and business verification (including KYC/KYB) and Connect onboarding as required before withdrawals are enabled. You are responsible for the accuracy of legal name, tax identifiers, bank details, and any payout destination information. Losses arising from incorrect instructions, closed accounts, or rejected transfers are your responsibility except to the extent caused solely by our proven gross negligence.
Withdrawal limits & cadence
Minimum and maximum withdrawal amounts, daily or monthly limits, and cooldown periods between withdrawals may apply as shown in the product or help documentation and may differ by subscription plan. We may change limits to reduce fraud or comply with law or processor requirements.
Currency conversion and international transfers (fees borne by you)
The Service may display balances and withdrawal amounts in a primary settlement currency (such as USD). If your bank account, payout rail, or any leg of settlement requires conversion to or from another currency, or if your processor settles in one currency and your bank credits another, you bear all foreign-exchange costs, spreads, markups, and related bank or processor fees. Exchange rates and fee components are set by banks, processors, or card networks, not by GetPayment, and may not match interbank mid-market rates. You authorize debits, withholdings, or netting of such fees from proceeds, balances, or future settlements.
Cross-border payouts, correspondent-bank fees, intermediary deductions, and wire transfer fees (incoming or outgoing) are likewise your responsibility unless mandatory consumer law in your jurisdiction provides otherwise.
Failed payouts, returns & recalls
If a payout fails, is returned, recalled, or subject to a clawback (including after alleged fraud or error), you authorize us and processors to reverse or adjust ledger entries and to charge any return fees, trace fees, or administrative costs to your balance. You remain liable for any deficit until satisfied.
Instant or expedited payouts
Where instant or expedited payout options are offered, additional per-transfer or percentage fees may apply as disclosed at the time of selection. Such fees are non-refundable once the payout is submitted, except where required by law.
Taxes on payouts
You are responsible for determining and remitting any taxes on amounts you receive. Informational tax forms or summaries may be provided by processors where applicable; GetPayment is not your tax adviser.
Acceptable use
You will use the Service in a lawful, honest, and professional manner. You agree not to misuse invoices, checkout links, balances, or payouts in any way that could harm payers, financial institutions, or the integrity of payment networks. Serious or repeated violations, including illegal or fraudulent payment activity, may result in immediate suspension or account lock as described in Prohibited payment conduct & enforcement and Suspension & termination.
You agree not to:
- Use the Service for unlawful, deceptive, discriminatory, or abusive purposes, or for products or services prohibited by our payment processors.
- Circumvent security, interfere with the Service, or attempt to access data or accounts you are not authorized to use.
- Send spam, malware, or upload content that infringes intellectual property or privacy rights.
- Misrepresent fees, taxes, or the nature of transactions, or manipulate analytics or invoice metrics in bad faith.
We may investigate violations and cooperate with law enforcement and payment partners.
Prohibited payment conduct & enforcement
GetPayment is built for legitimate commerce. You must use invoicing, payment collection, settlement, and withdrawal features only in compliance with these Terms, applicable law, sanctions and export controls, tax obligations, and the rules of payment processors and card or bank networks (collectively, "Payment Rules").
Strictly prohibited conduct
Without limiting other restrictions in these Terms, you must not use the Service to:
- Receive, move, conceal, or launder proceeds of crime; finance terrorism; pay or receive bribes or unlawful kickbacks; or evade lawful sanctions, embargoes, or reporting duties.
- Facilitate fraud against payers, issuers, or platforms, including fictitious sales, friendly fraud, collusive chargebacks, identity theft, account takeover, or misrepresentation of goods, services, pricing, or tax treatment.
- Miscode, split, or structure transactions to disguise their true nature, origin, or beneficiary; operate illegal gambling, unlicensed money transmission where a license is required, Ponzi or pyramid schemes, or other unlawful business models as determined under applicable law or Payment Rules.
- Circumvent velocity limits, risk controls, verification requirements, or processor prohibitions; or abuse the Service in any manner that exposes GetPayment, payers, or partners to undue legal, regulatory, or financial risk.
Account lock, suspension & remedies
If we reasonably believe you have engaged in, or are facilitating, illegal activity, serious fraud, or material violations of Payment Rules or these Terms, we may take protective action where permitted by law or contract, including without limitation: locking or suspending your account; disabling access to some or all features (including new invoices, checkout, or withdrawals); placing holds on balances or payouts pending investigation; reversing or offsetting transactions where processors or networks allow; requiring enhanced identity or business verification; terminating your access; and cooperating with payment processors, financial institutions, regulators, and law enforcement.
Where acute risk, legal process, processor mandates, or regulatory obligations require it, we may act without advance notice. You understand that funds may remain subject to processor settlement timing, chargebacks, reserves, clawbacks, or court or agency orders independent of GetPayment. Nothing in this section obligates us to monitor all transactions or guarantees detection of misconduct.
No legal advice. You are solely responsible for ensuring your use of the Service is lawful in every jurisdiction where you operate or solicit customers.
Intellectual property
The Service, including software, branding, templates, and documentation, is owned by GetPayment or our licensors and is protected by intellectual property laws. Except for the limited rights expressly granted here, no rights are transferred to you.
Feedback you provide may be used by us without obligation or compensation to you.
Disclaimers & limitation of liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION OR THAT DEFECTS WILL BE CORRECTED.
WE ARE NOT LIABLE FOR THIRD-PARTY SERVICES (INCLUDING PAYMENT PROCESSORS), NETWORK OUTAGES, BANK DELAYS, OR ACTIONS OF PAYERS OR ISSUING BANKS.
GetPayment does not provide legal, tax, or investment advice and owes no fiduciary duties to you in connection with the Service.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO GETPAYMENT FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100). WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, DATA, OR GOODWILL.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
Indemnification
You will defend, indemnify, and hold harmless GetPayment and its affiliates, directors, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from Your Content, your sales to customers, your violation of these Terms or law, or your infringement of third parties' rights.
Without limiting the foregoing, your indemnity includes claims and losses related to: chargebacks, disputes, payment reversals, and all associated fees and network assessments; incorrect tax or regulatory filings for your business; misdirected or fraudulent payout instructions you supply; and foreign-exchange, cross-border, wire, return, or expedited-payout fees incurred in connection with your use of payouts or withdrawals.
Suspension & termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, create risk or legal exposure, fail to pay amounts due, or if we cease offering the Service or are required to do so by law or payment partners. This includes, without limitation, circumstances described in Prohibited payment conduct & enforcement (such as suspected illegal or fraudulent payment activity), where we may lock your account or restrict withdrawals pending review or as directed by competent authorities or processors.
Upon termination, your right to use the Service ceases. Provisions that by nature should survive (including fees accrued, indemnity, limitation of liability, governing law) will survive.
Governing law & disputes
These Terms are governed by the laws of the jurisdiction stated in our corporate formation or operating documents (to be updated when finalized), excluding conflict-of- law rules. Subject to mandatory consumer protections in your country of residence, courts in that jurisdiction (or binding arbitration if we adopt an arbitration clause by notice) shall have exclusive jurisdiction over disputes, unless otherwise required by law.
You agree to attempt informal resolution by contacting us before commencing legal proceedings where reasonable.
General provisions
- Entire agreement: These Terms and the Privacy Policy constitute the entire agreement regarding the Service.
- Assignment: You may not assign these Terms without our consent; we may assign in connection with a merger or sale.
- Severability: If a provision is invalid, the remainder remains in effect.
- No waiver: Failure to enforce a provision is not a waiver.
- Changes:We may modify these Terms by posting an updated version and updating the "Last updated" date. Material changes may include additional notice (email or in-product). Continued use after the effective date constitutes acceptance where permitted by law.
